Client of Attorney Erin O’Leary Awarded More Than $130,000 in Damages Sustained in Altercation

In a recent decision from the Superior Court, Judicial District of Windham, Judge Robert E. Vacchelli awarded more than $130,000 in damages to a client of Suisman Shapiro for physical injuries and exemplary damages sustained in an altercation that occurred in 2007. The plaintiff, represented by Attorney Erin O'Leary, suffered a fractured ankle, facial lacerations and other injuries when he was assaulted by the defendant and fell down an entire flight of stairs.

In addition to medical expenses, the judgment included $90,000 in non-economic damages and more than $32,000 for punitive damages. Punitive damages are typically paid in excess of a plaintiff's provable injuries, so they are only awarded in special cases where the defendant's actions were wanton, reckless, or intentional.
