Client of Attorney Erin O’Leary Awarded More Than $130,000 in Damages Sustained in Altercation

In a recent decision from the Superior Court, Judicial District of Windham, Judge Robert E. Vacchelli awarded more than $130,000 in damages to a client of Suisman Shapiro for physical injuries and exemplary damages sustained in an altercation that occurred in 2007. The plaintiff, represented by Attorney Erin O’Leary, suffered a fractured ankle, facial lacerations and other injuries when he was assaulted by the defendant and fell down an entire flight of stairs.

In addition to medical expenses, the judgment included $90,000 in non-economic damages and more than $32,000 for punitive damages. Punitive damages are typically paid in excess of a plaintiff’s provable injuries, so they are only awarded in special cases where the defendant’s actions were wanton, reckless, or intentional.

Erin O’Leary is an associate at Suisman Shapiro, practicing in the area of personal injury law.
