Town of Groton Historic District Commission Represented by Attorney Michael P. Carey Wins Landmark Supreme Court Decision

On May 30, 2017 in the case of Mayer v. Historic District Commission of the Town of Groton, the Connecticut Supreme Court made new law regarding the rights of persons to appeal from actions of local historic district commissions. It established that the owners of property immediately abutting or within 100 feet of a property as to which a historic district commission takes an action do not automatically have the right to take an appeal to court from the action. Instead, they must plead and prove that they have themselves suffered an injury that is different than the alleged injury to the general public from the challenged action. This decision is the first Connecticut Supreme Court or Appellate Court decision addressing this issue.
