Workers' compensation after death: What your family should know

Workers' compensation is an important protection for workers. It guarantees that they are able to get the medical care they need and the compensation they deserve after getting hurt on the job.

Sometimes, people don't survive their workplace injuries, and that's where workers' compensation becomes even more important for their surviving family members. Death benefits pay for funeral expenses, weekly compensation and more.

How much will workers' compensation cover for a worker's funeral?

According to the state laws, workers' compensation policies pay out $4,000 for burial expenses if the employee died after Oct. 1, 1988. This is the limit for funeral expenses and is paid to the widow, widower or another responsible party, depending on the person responsible for the funeral.

How much will families be paid for a worker's death?

This partially depends on the amount the worker made in life. The weekly compensation paid to dependents is 75 percent of the person's weekly earnings after being reduced by taxation and the Federal Insurance Contribution Act. No less than $20 weekly will be paid to dependents.

The compensation is paid until the surviving spouse's death if they were the sole presumptive dependent. If there are also children who are dependent and living with the surviving spouse, this is paid in the same manner. However, if they live apart, the compensation is divided into parts.
